1. Service Description

Juncu.ai ("the Platform") is an online marketplace that connects users with local service providers for experiences, restaurant bookings, and accommodation reservations. The Platform facilitates the booking process and payment collection but does not itself provide the underlying services.

2. User Accounts

Users must create an account to make bookings. You must be at least 18 years old to use the Platform. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these terms.

3. Booking Process

When you submit a booking request, it is sent to the service provider for confirmation. Bookings are not guaranteed until confirmed by the provider. Payment is collected upon confirmation. Your booking request is processed with automated assistance.

4. Fees and Payments

A booking fee is charged per booking as consideration for Juncu's technology intermediation service. This fee does not constitute a deposit (caparra confirmatoria) under Art. 1385 of the Italian Civil Code and is non-refundable in the event of user cancellation. The amount of the booking fee may vary based on the user's reliability history and is always disclosed transparently before payment is completed. Service prices are set independently by providers. All payments are processed securely through Stripe. No-show penalty payment mandate (restaurants): in case of repeated no-shows, the Platform may require a valid payment method on file as a condition for further bookings. By completing a booking that requires a card on file, the user expressly authorises Juncu — under Art. 7 GDPR and in accordance with Stripe's merchant-initiated transaction (MIT) standards — to charge, off-session, a fixed per-person no-show penalty. The penalty amount is disclosed to the user prior to booking confirmation.

5. Cancellation and Refunds

Cancellation policies vary by service. Full or partial refunds of the service price may apply depending on when you cancel relative to the booking date. The booking fee is non-refundable in the event of user cancellation. Where the provider cancels, Juncu may, at its sole commercial discretion and as a goodwill gesture, refund the booking fee: such refund does not constitute a contractual obligation under Art. 1385 of the Italian Civil Code and carries no entitlement to double restitution. Specific refund windows are displayed during the booking process and on your booking details.

6. Right of Withdrawal

Under the EU Consumer Rights Directive (2011/83/EU), consumers generally have a 14-day right of withdrawal for online purchases. However, pursuant to Article 16(l) of the Directive, this right does not apply to contracts for the provision of accommodation (other than for residential purposes), catering, or services related to leisure activities where the contract provides for a specific date or period of performance. All services booked through the Platform fall under this exemption. By completing a booking, you acknowledge that the right of withdrawal does not apply to your purchase.

7. Liability

Juncu.ai acts as an intermediary and is not liable for the quality, safety, or legality of services provided by third-party providers. Providers are independent contractors, not employees of Juncu.ai. Specifically, we are not responsible for:

  • The accuracy of information provided by service providers
  • The quality, safety, or legality of experiences or services offered
  • Any damages, losses, or inconveniences arising from participation in booked services
  • Cancellations, modifications, or issues in the management of services by providers

8. Dispute Resolution

Any disputes or issues related to a booked service must be resolved directly with the responsible service provider. We will provide the provider's contact details when possible. While we may facilitate communication, we do not intervene in disputes between users and providers. 9. Acceptable Use

By accessing and using the Platform, you agree to:

  • Use the Platform in compliance with applicable laws
  • Provide truthful and accurate information in booking forms
  • Not use the Platform for fraudulent or illegal purposes
  • Not engage in behavior that could endanger your own or others' safety during booked services
  • Follow all instructions and guidelines provided by service providers

10. Platform Availability

The Platform is provided "as is" and "as available". We do not guarantee that the Platform will always be available, error-free, or secure. We are not responsible for any damages arising from the use or inability to use the Platform. We reserve the right to suspend or discontinue the service without prior notice for maintenance or other reasons.

11. Modifications to Terms

We reserve the right to modify these Terms and Conditions. Changes will be communicated to users via email and/or in-app notice, with reasonable advance notice before the effective date (a minimum of 15 days for material changes, except where shorter notice is required by law or for security reasons). Continued use of the Platform after the effective date constitutes acceptance of the updated Terms. If you do not wish to accept the changes, you may request account deletion before the effective date. For structural changes affecting express authorisations you have granted (e.g. new payment-charging or data-processing arrangements requiring specific consent), Juncu may require explicit re-acceptance as required by applicable law.

12. Governing Law

These terms are governed by the laws of the Italian Republic and the European Union. Any disputes shall be subject to the jurisdiction of the courts of Italy.
